The Union of Architects in the State of Rio Grande do Sul (Saergs) obtained a legal victory that will guarantee the reimbursement of annuities paid by professionals to CREA in the years 2007 to 2011. It is estimated that around 12 thousand architects and urban planners in Rio Grande do Sul will benefit with amounts between R$ 2,400 and R$ 2,800 per professional.
According to the lawyer of Saergs, Filipe Diffini Santa Maria, the action was filed by Saergs when the category was overcharged. At the time, the council applied readjustments to annuities greater than the correction limit stipulated by the regulation. The lawsuit was filed in 2012 and, after 11 years, it is in the execution phase, that is, it is ready to pay the amounts owed to architects and urban planners.
All architects and urban planners who paid an annuity to the council at the time benefited. To receive the amount, each professional needs to issue a power of attorney to Saergs and send a copy of the identity card to qualify for the process. The expectation, estimates Santa Maria, is that the resources will be available 60 days after the presentation of the documentation to the Judiciary.

In addition to strengthening the category’s representation with public bodies and employers, the movement provides opportunities for new collective actions. “This action is an example of the main motivation for the existence of Saergs, which is the legal representation of the category.
