PSOL filed a Direct Unconstitutionality Action (ADI) 7597, in the Federal Supreme Court (STF), to overturn a law that establishes the “Awareness Campaign against Abortion for Women in the State of Goiás”.
The action was distributed to Minister Edson Fachin. Among other points, the law in Goiás establishes the date of August 8th as “State Awareness Day against Abortion”.
The law provides guidelines for the campaign against abortion, such as holding lectures and seminars on the risks of the practice, providing psychological and social assistance to pregnant women who want to abort, prioritizing the maintenance of the fetus’ life, and offering Ultrasound examination woman with unborn child’s heartbeat.
According to the left-wing party, the Goiás law aims to prevent pregnant women from accessing the abortion procedure, even in legal cases, discouraging them from obtaining the services provided for by law, as well as “subjecting them to torture through visualization of the ultrasound exam”.
According to PSOL, the law violates current understandings of reproductive justice, which impose on the State the duty to guarantee all the necessary conditions for women to exercise their choices.
The left-wing party claims to the STF that the rule violates the constitutional principle of human dignity and women’s rights to autonomy, freedom, equality, health and not to be subjected to torture or inhuman or degrading treatment.
The PSOL still maintains that the Goiás law regulated matters of civil rights and guidelines and bases for education, whose exclusive legislative competence belongs to the Union.
