Four women were reportedly victims of medical error following aesthetic procedures carried out by plastic surgeon Dagmar João Maester, aged 61. In Goiás there are seven actions against the professional and in Maranhão there are four other processes. Three patients died and one had sequelae.
Dagmar is registered as a doctor in Goiás, Distrito Federal, Maranhão and São Paulo. He specializes in general surgery and plastic surgery and is currently in good standing at the Regional Council of Medicine of Goiás (Cremego). The surgeon’s defense said it will not comment on the cases.
In a statement, the Brazilian Society of Plastic Surgery (SBCP) reported that it is following the case and sympathizes with the family of the patient from Goiás who died. However, he said that it is not up to the entity to judge the professional’s conduct regarding the facts, as this role belongs to the regional councils.
Cremego stated that all complaints related to the ethical conduct of doctors are investigated, but are processed in complete confidentiality, as determined by the Medical Professional-Ethical Process Code. It also reported that Dagmar was banned from practicing his profession for 30 days in 2017, after causing harm to a patient.
Law Suit
There are seven cases against the doctor in the Court of Justice of Goiás (TJ-GO), two of which are under judicial secrecy. There are four other cases at the Maranhão Court of Justice. There are two lawsuits for medical error, one for simple homicide and one lawsuit for image rights.
In Goiás, there are two actions for the death of patient Marisa Rodrigues da Cunha, aged 62. Compensation for moral damage caused by medical error for patient Keila Patricia Dias da Silva. In addition to these, there is an action on moral rights and one for compensation for material damage caused.
In July last year, g1 published a report stating that the doctor was being investigated by the Civil Police for the death of patients Robenha Pereira and Patriciana Nunes Barros, following aesthetic procedures carried out by him in the city of Imperatriz, 629 km from São Luís.
Marisa Case
The elderly woman underwent cosmetic surgery for breast reduction, abdominoplasty and liposuction on April 14 of this year, at Hospital Goiânia Leste. Two days later she died at home from complications from the procedure. g1 tried to contact the hospital, but was unsuccessful.
According to the complaint made by the Public Ministry of Goiás (MPGO), the elderly woman underwent pre-operative tests requested by the doctor, which found that she was pre-diabetic, hypertensive and used thyroid hormone. According to the agency, Marisa was unable to undergo surgery.
The document also says that one day after the procedure, the doctor discharged the victim. At home, she started vomiting frequently and, as a result, her daughter began to question the doctor. Initially he said the symptoms were normal and then asked her to stop taking all her medications.
Marisa’s daughter even asked the doctor’s nurse for help, who spoke to the professional. But according to the complaint, at no point did Dagmar advise the victim to return to the hospital. The elderly woman’s daughter called for help, but Marisa couldn’t resist and died at home.
According to the cadaveric examination report, the elderly woman died due to changes related to the surgery, which resulted in pulmonary thromboembolism. The MPGO reported the doctor alleging that he failed to provide assistance and, as a result, acted with malpractice and negligence.
Keila case
In January 2022, Dagmar also operated on patient Keila Patricia Dias da Silva, at Hospital Goiânia Leste, in the capital. She also underwent three types of aesthetic procedures at once for a cost of R$19,000. However, the surgery did not go as the woman wanted.
On TV Anhanguera, the patient said that the doctor removed the skin from the wrong breast and, as a result, the breasts were different sizes. After the surgery, the patient went to the doctor to ask for her money back. The doctor replied that he did not agree with this and that they should resolve it in court.
“He was supposed to have surgery on his left chest, but he did it on his right chest. He removed the skin on my right breast that he couldn’t remove, so I was left with a very tiny right breast and dysplasia on the left. I can’t look at myself in the mirror”, said the patient, who wants the money to repair the error.
Robenha case
Robenha died on February 15, 2022 after having an abdominoplasty, liposculpture and mastopexy on her breasts at a private hospital in the city. The death certificate indicated acute respiratory failure, acute lung edema and postoperative pulmonary thromboembolism.
“I have no doubt about the negligence that occurred, because as soon as he finished the surgery, he left the surgical box and immediately went to the hotel. She went to the infirmary and until then everything was fine, but soon after she started to feel pain in her back”, said the patient’s daughter, Tâmara Regina Pereira.
Patriciana case
The g1 report, published in July last year, also reveals that a month after Robenha’s death, parliamentary advisor Patriciana Nunes also died after undergoing an abdominoplasty and breast implant surgery performed by Dagmar.
Patriciana’s husband even sent videos to the doctor showing his wife feeling ill. In response to the messages, Dagmar said it could be an anxiety attack and recommended a psychiatrist. Five days later, Patriciana passed away.
