As of next Monday, June 12th, Complementary Law nº 726/2023, which establishes the rules for visual communication in Caxias do Sul, comes into force. Known as the Law of Facades, the legislation underwent reformulations in 2023 with the aim of simplifying procedures for city entrepreneurs. Mayor Adiló Didomenico sanctioned the law on April 5. The main points of the norm were presented during the Municipal Environment Week, in an activity that was attended by the municipal secretary of the Environment, João Uez, and the architect of Semma Liete Vebber Simionato.
According to the secretary, before the new law, commercial establishments could have only one sign of up to 3 square meters, upon presentation of documentation and approval, without charging fees. It is now allowed to have up to three units with the same total area. This measurement applies to dimensions of 0.3 or 0.6, depending on the area of \u200b\u200bthe facade. In addition, it is no longer necessary to register, obtain authorization or present documentation or pay fees, as long as the license plates comply with these measures.
The simplification adopted in the new legislation is based on the principle of good faith of entrepreneurs, aiming to speed up the analysis processes. Since it was implemented 11 years ago, the law has contributed to improving the city’s visual appearance and enhancing local businesses. The current reformulation offers practicality in the understanding of the norms.
It is important to note that all establishments remain subject to inspections. In addition, the installation of equipment on the marquees is not allowed.
In the Historic Center, comprising the quadrilateral formed by Ruas Alfredo Chaves, Rua Bento Gonçalves, Rua Moreira César and Rua Os Dezoito do Forte, including the vicinity of the Railway Station, signs must be a maximum of 3 square meters. In that same region, the use of wind banners or flags, which are pennants placed on the sidewalks, is prohibited.
Outside the Historic Center, that is, in other areas of the municipality, the maximum area allowed is calculated by multiplying the value of the front of the establishment by 0.6. In these cases, authorization, presentation of documentation (to be specified in the decree) and payment of an annual fee are required. The renewal, in all cases, will be valid for 5 years (60 months). In the windows, it is allowed to use 50% of the space, being allowed the use of 100% on festive dates, such as Mother’s Day, Father’s Day, Easter and Christmas, for example.
The entire process of drafting and implementing the new law was the result of joint work between the public authorities and the private sector. Entities such as CDL, Sindilojas, Sindigêneros, Segh Uva e Vinho, CIC Caxias, Sindipetro, Vivacidade and Compahc participated in the process, in addition to teams from the Secretariats for the Environment, Urbanism, Economic Development and Innovation and Culture, through Dippahc, and the Chamber of Aldermen.
