Judge Henaldo Silva Moreira, of the 5th Court of Public Finance of the Federal District, determined that the Health Secretary of the DF, Manoel Pafiadache, inform if there is a shortage of oxygen for home use in Brasília. The magistrate established a period of 30 days for the information to be made available.
In the event of shortages, according to the magistrate, the Health Department should inform the deadline for regularization and “forward a copy of the process/procedure initiated to regularize the supply of medical supplies claimed by the plaintiff”.
The judge responded to a request from the Public Defender’s Office in a lawsuit filed by Isaac Rodrigues, a resident of Planaltina (DF). He filed a lawsuit after his son, Pedro Duarte, only 5 months old, had his medical discharge postponed due to lack of oxygen for home installation.
The case was revealed by R7, in a report that showed that, even in the midst of the Covid-19 pandemic, the Health Department had let a contract with the White Martins company expire for the supply of oxygen to patients who could be hospitalized at home. . Without the provision of the service, those who are in a stable situation and could receive treatment at home occupy a hospital bed.
The absence of the contract occurs at a time when 100% of the beds destined for Covid, both adults and pediatrics, are occupied in the DF. After the magistrate’s decision, the oxygen cylinder was installed in the baby’s house, by court order. The child, however, is still without the utensil to allow breathing during displacements – necessary for him to move for consultations, exams and physiotherapy.

Pedro suffers from an inborn error of immunity and severe bronchopulmonary dysplasia. His stay in a hospital environment creates risks, due to the probability of infection by Covid-19 and other infections. The baby was born premature and, even though he was treated by a multidisciplinary team, he suffered from the lack of supplies for exams at the HMIB (Hospital Materno Infantil de Brasília). Due to the lack of ICU beds, other children, infected by Covid, were even intubated in the emergency room of the health unit.
