Advising the population on real estate regularization procedures and stable unions, and clarifying doubts about the purchase and sale of properties, donations, inventories, divorces and wills, are the focus of the 1st edition of the Family Notarial Journey and the 2nd Notarial Advisory Journey for Open Doors, a free advisory event that will be held on September 30th by the Porto Alegre notary offices, at Largo Glênio Peres, located in the Historic Center of Porto Alegre, from 9am to 2pm.
On this occasion, notaries and clerks from Notary Public Offices will be concentrated in a single location to provide personal and free service to all interested parties, with the aim of guiding the population on the importance of regularizing coexistence and housing, two basic pillars of construction of the Brazilian family. In the actions, Public Declaratory Deeds of Organ Donation will also be carried out, due to the Green September campaign, a month to encourage organ and tissue donation.
In addition to Porto Alegre, the cities of Erechim, Rio Grande, Carazinho, Pouso Novo, Santo Ângelo, Butiá, Canguçu, Gravataí, Passo Fundo, Santa Rosa, Três Coroas, Pelotas, Novo Hamburgo, São Pedro do Sul, Seberi, Cacequi, Santo Expedito do Sul, Arvorezinha, Santa Bárbara do Sul, Torres, Três Passos, Sapiranga, São Leopoldo, Caxias do Sul, Entre-Ijuís, Tiradentes do Sul, Doutor Maurício Cardoso, Condor, Inhacorá, Uruguaiana, Dom Feliciano, Cruz Alta and Minas do Leão will also promote the actions.
“Living together” without getting married has become an increasingly common trend in Brazil, but the risks of living together informally end up taking their toll, with lawsuits challenging assets in court, disputes over pensions, inheritance and difficulties in including a partner. in health plans, life insurance and other benefits. Legal proceedings that could be avoided with the regularization of stable unions between couples, both homoaffective and heteroaffective. According to the latest Census, more than a third of unions in the country are informal, while marriages are falling year after year.

Declaration expressing willingness to be a free organ donor
In the actions, citizens will be able to make the Public Declaratory Deed of Organ Donation free of charge. As a result of the Cooperation Agreement to encourage the donation of organs and tissues in the State, signed on October 5, 2022, the CNB/RS created the Organ Donation Notarial Center, a system managed by the CNB/RS to enable interconnection and consultation by hospitals and the Transplant Center of RS, in a confidential manner, of public declaratory deeds containing the expression of will regarding organ donation, after the death of the potential donor.
The objective of the project is to allow notary offices to offer broad and free assistance to the population regarding the possibility of declaring, with a view to encouraging the donation of organs and tissues, and aims to establish the routine for sending information about organ and tissue donors to the State Transplant Center of the RS Health Department.
The expression of will through a public deed will act as another convincing tool for the family, as authorization for the donation of the family member’s organs will still be required.
Housing and Tax Reform
Another focus of the action is to guide citizens on how to regularize their housing. Data from the Ministry of Integration and Regional Development indicate that around 60% of properties in Brazil present some type of irregularity, including the lack of a public deed, an essential document for proving the legal transaction. In addition to the costs of regularization, anyone who does not have a public deed may even lose the property or face restrictions when using the property as collateral.
About to advance in the National Congress, Tax Reform is another issue that afflicts property owners, who may seek information on how to regularize asset transfers with lower tax payments, since the new taxation may impact transmission costs through inventory, favoring eventual living donations. The text, still being processed in the National Congress, should consolidate the understanding of the Federal Supreme Court (STF) on the progressiveness of the Causa Mortis Transmission Tax (ITCMD) for those with greater assets.
